Terms of Agreement (T&Cs)

1. Agreement Overview:

• These terms outline your rights and responsibilities, as well as those of K2SHOTIT.
• “You” refers to the Client, and “We” refers to K2SHOTIT.

2. Wedding Photography Services:

• We commit to providing wedding photography services as per the Contract.
• The Contract encompasses all terms agreed upon between you and us.

3. Booking and Payment:

• A deposit of not less than 70% of the total cost of the chosen package is due upon submission of a proforma invoice.
• The balance of the Package Fee must be paid 30 days before the wedding date.
• Failure to meet payment deadlines may result in service denial or contract cancellation.
• Kindly note that half of the deposit is non-refundable

4. Package Inclusions:

• The Package Fee covers photography within Accra.
• Travel outside Accra and additional services require prior discussion and agreement.
• Additional time may be charged at specified rates, as per our current price list.

5. Additional Services:

• Separate fees apply to any additional services ordered, payable in full before delivery.

6. Photographer’s Discretion:

• While we discuss your preferences, certain factors like weather may impact the outcome.
• You grant us full artistic license for content, arrangement, composition, and location.
• Cooperation in identifying important individuals during the event is crucial.

7. Responsibilities:

• You are responsible for any injury, loss, or damage caused to the photographer or equipment by your guests. 
• We will not be held accountable for not photographing desired guests if there is no one to assist in identifying and gathering people for photographs. We are not responsible if key individuals fail to appear or cooperate during photography, or for missed images due to details not revealed to K2SHOTIT or beyond the photographer’s control.

8. Color Balance and Delivery:

• We strive for good color balance, but factors such as lighting conditions may affect it.
• Digital image delivery is expected between 6 to 8 weeks from the wedding date.

9. Digital Media Storage:

• We retain your digital media for 6 months; it is advisable to create backups for protection.

10. Usage Rights:

• You receive Usage Rights for personal use only; commercial use is strictly prohibited.
• Copyright for all images remains with K2SHOTIT, and contact us for clarification on usage rights.

11. Display Rights:

• We reserve the right to use or display any images created under this Contract for studio, portfolio, exhibitions, or marketing purposes.

12. Force Majeure:

• In the unlikely event that we cannot perform the Contract due to reasons beyond our control (e.g., death, injury, illness), our liability is limited to a full refund of all fees paid.

13. Contract Cancellation:

• You may cancel the Contract at any time in writing.
• Compensation for cancellation varies based on the notice period:
  • 121 days or more before the wedding: you forfeit 35% of total cost of chosen package (i.e. non-refundable deposit)
  • 31 to 120 days before wedding: you forfeit 50% of chosen package
  • 30 days or less: 75% of total cost of chosen package

14. Postponement:

• If the wedding date is postponed, we may, at our discretion, agree to reschedule and apply all monies paid toward the fees for the new date.

15. Professionalism:

• We will exercise reasonable skill, care, and judgment expected of a professional photographer.
• We are not liable for events beyond our reasonable control.
• Our liability is limited to the total amount paid under this Contract.
